Developer/School Impact Fees

NUSD collects school impact fees on new residential and commercial construction within District boundaries. 

The NUSD Board of Education, at its meeting held on March 20, 2018, approved Resolution No. 2096 which states these fees, effective May 19, 2018:

$3.79 per square foot for new residential habitable space.

$0.61 per square foot for new commercial and industrial.

$0.14 per square foot for mini storage.

The procedure:

Individuals submitting plans to the City of Newark shall be directed to the NUSD Business Office to meet with the Administrative Assistant to pay these fees.

The fees are based on the square footage listed in the “PLAN CHECK COMMENTS” letter issued by the City of Newark (Building Inspection Division). A copy of this City document must be submitted to NUSD at the time of fee payment.

Additions or reconstruction over 500 square feet to an existing single family dwelling must pay these fees. Fees must be paid on the total square footage of the addition (not just on the square footage over 500) per California Education Code § 17620 (a)(1)(C)(i).

NUSD will require a Certificate of Compliance (triplicate) form to be filled-out and signed at the time of fee payment.

March 2018: NOTICE OF HEARING REGARDING PROPOSED ADOPTION OF A DEVELOPER FEE STUDY AND THE INCREASE OF THE STATUTORY SCHOOL FEE

NOTICE IS HEREBY GIVEN that the Governing Board of the Newark Unified School District will hold a hearing and consider input from the public on the proposed adoption of a Developer Fee Justification Study for the District and an increase in the statutory school facility fee (“Level I Fee”) on new residential and commercial/industrial developments as approved by the State Allocation Board on January 24, 2018.  The adoption of the Study and the increase of the Level I Fee are necessary to fund the construction of needed school facilities to accommodate students due to development.

Members of the public are invited to comment in writing, on or before March 20, 2018, or appear in person at the hearing at 7:00 pm on March 20, 2018, at Newark Unified School District Office (Boardroom) 5715 Musick Ave, Newark, CA, 94560.
